These Terms & Conditions (“Terms”) govern your access and use of the Callio website, AI receptionist platform, SMS messaging services, call management services, appointment scheduling tools, and all related products and services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
2. Description of Services
Callio provides AI-powered receptionist and communication services, which may include AI call answering, appointment scheduling, call routing, SMS appointment confirmations, reminders, missed call follow-ups, customer support messaging, AI-generated call summaries and transcripts, and business communication tools. Services may change or improve over time without prior notice.
3. User Responsibilities
You agree to provide accurate information, maintain the confidentiality of your account credentials, use the services only for lawful purposes, comply with all applicable laws, and obtain any required consent before recording calls or communicating with your customers. You are responsible for all activities that occur under your account.
4. SMS Terms
By providing your mobile number or opting in, you agree to receive customer care SMS messages from Callio or businesses using the Callio platform. These messages may include appointment confirmations, reminders, updates, rescheduling notices, missed call follow-ups, and customer support communications. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe. Reply HELP for assistance. Consent to receive SMS messages is not a condition of purchasing any product or service.
5. Consent
Users may opt in by verbal consent, submitting website contact forms, appointment request forms, or other documented methods supported by Callio. Callio maintains records of consent where applicable.
6. Acceptable Use
You agree not to use the services to send spam or unsolicited messages, violate applicable laws, harass or threaten others, distribute malicious software, engage in fraud, or infringe intellectual property rights. Callio may suspend or terminate accounts that violate these terms.
7. Third-party Services
Our services may integrate with third-party providers such as Twilio for communications. These providers operate under their own terms and privacy policies. Callio is not responsible for interruptions or failures caused by third-party services.
8. Intellectual Property
All software, trademarks, logos, content, and technology provided by Callio are the property of Callio or its licensors. You may not copy, modify, distribute, or create derivative works without prior written permission.
9. Disclaimer of Warranties
The services are provided “as is” and “as available.” To the fullest extent permitted by law, Callio disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation.
10. Limitation of Liability
To the maximum extent permitted by law, Callio shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of your use of the services. Our total liability shall not exceed the amount you paid for the services in the twelve (12) months preceding the event giving rise to the claim.
11. Indemnification
You agree to defend, indemnify, and hold harmless Callio, its owners, employees, affiliates, and service providers from any claims, damages, liabilities, costs, or expenses arising from your use of the services, your violation of these terms, or your violation of any applicable law or third-party right.
12. Suspension and Termination
We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent or unlawful activity, or if continued use presents a security risk.
13. Changes to these Terms
We may update these Terms from time to time. Updated versions will be posted on this page with a revised effective date. Continued use of the services constitutes acceptance of the revised Terms.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.
